Introduction

Welcome to Motorcycle Training Concepts (the “Site”). Motorcycle Training Concepts is a doing business as (DBA) of DanDanTheFireman LLC (“Company,” “we,” “us,” or “our”).

These Terms of Service, together with our Refund Policy, Shipping Policy, and Privacy Policy (collectively, the “Agreement”), govern your access to and use of the Site and any products, content, materials, or services offered through the Site.

By accessing, browsing, purchasing from, or using this Site, you agree to be bound by this Agreement. If you do not agree, do not use the Site.

Motorcycle riding is an inherently dangerous activity that carries a risk of serious injury, permanent disability, or death.

By accessing this Site or using any product offered through it, you acknowledge and agree that motorcycle riding and related training activities involve known and unknown risks that cannot be eliminated, regardless of instruction, preparation, or equipment.

Educational Use Only — No Certification or Professional Instruction

All content, products, materials, books, digital downloads, videos, drills, diagrams, and information provided by Motorcycle Training Concepts are offered for educational and informational purposes only.

Motorcycle Training Concepts and DanDanTheFireman LLC are not:

  • A motorcycle riding school
  • A licensing authority
  • A government-approved training provider
  • A substitute for in-person professional instruction

Nothing on this Site constitutes professional riding instruction, certification, medical advice, or legal advice.

You are solely responsible for determining whether any information, drills, or techniques are appropriate for your skill level, motorcycle, physical condition, environment, and riding conditions.

Assumption of Risk

Release of Liability

To the fullest extent permitted by law, you hereby release, waive, discharge, and hold harmless DanDanTheFireman LLC, doing business as Motorcycle Training Concepts, and its owners, officers, directors, employees, contractors, affiliates, agents, and representatives from any and all claims, demands, damages, injuries, losses, liabilities, or causes of action arising out of or related to:

  • Your use or misuse of the Site or products
  • Motorcycle riding or training activities
  • Reliance on information provided through the Site
  • Personal injury, property damage, or death

This release applies whether a claim arises from negligence or otherwise.

Purchases, Digital Content & Access

Some physical products include instant-access digital content.

You acknowledge and agree that:

  • Digital content is delivered immediately upon purchase
  • Digital products are non-refundable
  • Access to digital materials constitutes delivery of value
  • Physical products are subject to the Refund Policy

User Responsibilities

Intellectual Property Rights

All content on this Site, including but not limited to text, graphics, illustrations, videos, audio, drills, diagrams, PDFs, and training materials, is the exclusive intellectual property of DanDanTheFireman LLC and is protected by U.S. and international copyright laws.

You may not:

  • Copy, reproduce, distribute, or share content
  • Resell or sublicense materials
  • Create derivative works
  • Use content for commercial purposes

Personal, non-commercial use only.

Refusal & Termination of Service

We reserve the right to refuse service, cancel orders, suspend access, or terminate accounts at any time, for any reason or no reason, including but not limited to violations of this Agreement.

Arbitration & Waiver of Jury Trial / Class Actions

PLEASE READ CAREFULLY.

Any dispute, claim, or controversy arising out of or relating to this Agreement, your use of the Site, or any product purchased shall be resolved exclusively through binding individual arbitration conducted in Pima County, Arizona, under the rules of the American Arbitration Association.

You expressly waive:

  • The right to a jury trial
  • The right to participate in a class action
  • The right to consolidate claims

Arbitration shall be confidential and conducted on an individual basis only.

Indemnification

You agree to defend, indemnify, and hold harmless DanDanTheFireman LLC, doing business as Motorcycle Training Concepts, from any and all claims, damages, losses, liabilities, costs, and expenses (including attorneys’ fees) arising from:

  • Your use of the Site
  • Your use of any product or content
  • Your motorcycle operation or training activities
  • Your violation of this Agreement

Limitation of Liability

To the maximum extent permitted by law, DanDanTheFireman LLC shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including personal injury or death, arising from your use of the Site or products.

If liability is found, total liability shall not exceed the amount paid for the specific product giving rise to the claim.

Disclaimer of Warranties

All products, services, and content are provided on an “AS IS” and “AS AVAILABLE” basis.

We make no warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of the State of Arizona, without regard to conflict-of-law principles.
